General Terms and Conditions of Sale
Last updated: [PUBLICATION DATE]
These General Terms and Conditions of Sale (hereinafter, the “Terms”) govern the purchase of the products offered on the website [DOMAIN] (hereinafter, the “Website” or “PITBOX”). Placing an order implies full and unreserved acceptance of these Terms in the version in force at the time of purchase. Customers are advised to read, print or save them before placing any order.
1. Seller’s identity
In compliance with Article 10 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), and with the Consolidated Text of the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007, hereinafter “TRLGDCU”), the details of the Website owner are provided:
- Owner / seller: [FULL NAME OR COMPANY NAME]
- Tax ID (NIF/CIF): [NIF/CIF]
- Registered address: [FULL REGISTERED ADDRESS]
- Telephone: [TELEPHONE]
- E-mail: pitbox.garaje@gmail.com
- Commercial Registry details: [REGISTRY DETAILS if applicable — Commercial Registry of [PROVINCE], Volume, Sheet, Page]
- Trade name: PITBOX
For any query, incident or communication relating to an order, the customer may contact pitbox.garaje@gmail.com, which is the preferred means of contact and provides a written record.
2. Purpose and products
PITBOX is an online shop dedicated to the sale of handmade, made-to-order sim racing button boxes. The products have the following particular features, which the customer declares to know and accept:
- Handcrafted / handmade products: each unit is made manually, so slight aesthetic variations may exist (finishes, shades, print texture) which do not constitute a defect or lack of conformity but are inherent to a handcrafted product.
- Made to order: products are not usually held in stock but are manufactured once the order is confirmed and paid.
- Limited series: certain models may be offered in limited runs and subject to material availability; once a series is sold out, PITBOX does not guarantee restocking.
- Bespoke units (3D configurator): through the configurator available on the Website, the customer can design and personalise their button box (layout and number of controls, materials, colours, engravings, etc.), obtaining a product made to their individual specifications. These bespoke units are considered personalised goods and are excluded from the right of withdrawal, as detailed on the Shipping and Returns page.
3. Pre-contractual information
Before placing the order, and in accordance with Articles 60 and 97 TRLGDCU, the customer has access on the Website to the relevant pre-contractual information: essential product features, seller’s identity and contact details, total price including taxes and all additional transport costs, payment procedure, manufacturing and delivery times, existence or, where applicable, exclusion of the right of withdrawal together with its conditions, deadline and form, a reminder of the legal guarantee of conformity, and these Terms. Before completing the purchase of a bespoke product, the customer expressly confirms, via a checkbox, that they have been informed that such product is excluded from the right of withdrawal.
4. Prices and taxes
The prices of each product are shown in euros (€) on the relevant product page. The applicable price is the one in force at the time the order is placed. PITBOX reserves the right to change prices at any time, without this affecting orders already confirmed.
Applicable taxes are determined according to the tax zone of the shipping destination, which is calculated automatically during checkout. To facilitate this calculation, the Website may preselect the visitor’s country from their approximate location (see the Privacy Policy); the customer can manually change this selection at any time and the final tax amount is set according to the delivery address provided. The breakdown of taxes and shipping costs is always shown before payment is confirmed.
a) Mainland Spain, Balearic Islands and the rest of the European Union
Prices are shown including Value Added Tax (VAT) at 21%. In sales to final consumers (individuals) in other EU Member States, the corresponding VAT regime applies under current legislation, with the tax amount likewise included in the final price shown.
b) Canary Islands, Ceuta and Melilla — VAT exemption
These territories are not part of the Spanish VAT application area. Consequently, shipments to the Canary Islands, Ceuta and Melilla are considered VAT-exempt exports (Article 21 of VAT Law 37/1992). The price will be shown without VAT for these destinations.
In return, the customer accepts that, upon arrival of the goods in the destination territory, the indirect taxes of that territory may become due — IGIC (Canary Islands General Indirect Tax) in the Canary Islands or IPSI (Tax on Production, Services and Imports) in Ceuta and Melilla — as well as any applicable customs duties, fees and clearance management costs. All these amounts, as well as the import clearance procedures, are borne exclusively by the customer and are not included in the price or in the shipping costs paid to PITBOX. PITBOX will provide the necessary export documentation (commercial invoice, etc.).
5. Purchase process and confirmation
The purchase process is as follows:
- 1. The customer selects the product or configures it to order using the 3D configurator.
- 2. Adds the product to the cart and proceeds to checkout, where they enter their contact details and shipping address, and view the breakdown of price, taxes and shipping costs by destination zone.
- 3. Accepts these Terms and the Privacy Policy, and has technical means to identify and correct input errors before confirming the order.
- 4. Selects the payment method and confirms the order by clicking the completion button, unambiguously labelled with the wording “order with obligation to pay” (Art. 98.2 TRLGDCU).
- 5. Once payment is completed, PITBOX will send the customer, without undue delay, an order confirmation by e-mail (acknowledgement of receipt, Art. 28 LSSI) to the address provided, which serves as proof and contains the essential purchase details. The contract is deemed concluded at that moment.
PITBOX will confirm the concluded contract on a durable medium, with all the information required by Article 97 TRLGDCU, within a reasonable time after conclusion of the contract (Art. 98.7 TRLGDCU). The language of the contract is Spanish or English, according to the one selected by the customer. If the customer detects an error in the data entered, they must report it immediately to pitbox.garaje@gmail.com for correction before manufacturing begins.
6. Payment methods
Payment is made through an external payment gateway [GATEWAY TO BE DEFINED, e.g. Stripe], which accepts credit/debit cards and, where applicable, other methods enabled on the Website. Card details are entered in a secure environment of the payment provider; PITBOX does not store the full card number or the security code (CVC), keeping only the brand and the last four digits for order management purposes. The amount is charged when the order is confirmed, unless otherwise indicated at checkout.
7. Availability
Since products are handcrafted and made to order, availability may be subject to material stock, especially for limited series. If, after an order is confirmed, its manufacture or delivery becomes impossible due to supervening causes (lack of materials, force majeure or others), PITBOX will inform the customer as soon as possible and will proceed, at the customer’s choice, to replace it with an equivalent product or to fully refund the amounts paid, without this giving rise to any additional compensation.
8. Clauses and consumer protection
These Terms have been drafted in a clear, simple and comprehensible manner, respecting the balance between the parties and without including unfair terms under Articles 80, 82 et seq. TRLGDCU. No provision of these Terms limits the rights that consumer protection law grants to the consumer on a mandatory basis.
9. Dispute resolution and applicable law
9.1. Complaints
The customer may address any complaint to PITBOX via e-mail at pitbox.garaje@gmail.com. PITBOX undertakes to handle and respond to complaints as quickly as possible and to seek an amicable solution. [IF APPLICABLE: availability of official complaint forms for the consumer in accordance with the regional legislation of [AUTONOMOUS COMMUNITY].]
9.2. Alternative Dispute Resolution (ADR)
Please note that the European Online Dispute Resolution (ODR) platform, created by Regulation (EU) No 524/2013, ceased operating on 20 July 2025 pursuant to Regulation (EU) 2024/3228, and is therefore no longer available for submitting new complaints.
Notwithstanding the above, consumers residing in the European Union may turn to the accredited alternative dispute resolution (ADR) entities under Law 7/2017 of 2 November and Directive 2013/11/EU, as well as to the competent consumer bodies. [IF APPLICABLE: PITBOX is a member of the alternative dispute resolution entity [ENTITY NAME], which the consumer may contact at [DETAILS/LINK].] In Spain, the consumer may also turn to the Consumer Arbitration Boards (Juntas Arbitrales de Consumo) and to municipal and regional consumer information offices. For cross-border disputes within the EU, the consumer may turn to the European Consumer Centres Network (ECC-Net / CEC Spain).
9.3. Applicable law and jurisdiction
These Terms and the contractual relationships between PITBOX and the customer are governed by Spanish law. For the resolution of any dispute, and where the customer is a consumer, the courts and tribunals of the consumer’s place of residence shall have jurisdiction, in accordance with consumer protection law and applicable procedural legislation. In cross-border sales within the EU, the consumer retains the protection afforded by the mandatory provisions of the law of their country of habitual residence.
Shipping, Returns and Right of Withdrawal
A) Shipping
1. Geographic scope
PITBOX ships to Spain (including the Canary Islands, Ceuta and Melilla) and to the rest of the European Union. For shipments to other destinations, please enquire in advance at pitbox.garaje@gmail.com.
2. Timeframes: manufacturing + shipping
The total delivery time consists of two phases:
- Manufacturing: as these are handmade, made-to-order products, the estimated manufacturing time is 2 to 3 weeks from payment confirmation. During periods of high demand or for especially complex configurations, this period may be extended, in which case the customer will be informed.
- Transport: once the product is manufactured, the carrier’s transport time is added, which varies by destination zone [INDICATIVE TIME BY ZONE, e.g. mainland Spain 24-72 h; Balearics/Canary Islands/Ceuta/Melilla and EU: [TIME]].
The stated times are estimates. In any case, and in accordance with Article 66 bis TRLGDCU, unless otherwise agreed, PITBOX will deliver the products within a maximum of 30 calendar days from the conclusion of the contract; for made-to-order goods, this period refers to the overall manufacturing and shipping process communicated to the customer. If PITBOX fails to deliver within the agreed period, the consumer may request delivery within an additional appropriate period and, if this is not met, terminate the contract with the right to a refund of the amounts paid.
3. Shipping costs
Shipping costs are calculated by destination zone and shown itemised at checkout before the order is confirmed. As a guide:
- Mainland Spain: [AMOUNT / free from [AMOUNT]]
- Balearic Islands: [AMOUNT]
- Canary Islands, Ceuta and Melilla: [AMOUNT] (does not include taxes or customs charges at destination, which are borne by the customer — see the General Terms page, prices and taxes section).
- Rest of the European Union: [AMOUNT per country or band]
4. Tracking
Once the order has been dispatched, PITBOX will send the customer, by e-mail, the shipping confirmation together with the tracking number and the carrier’s details, where the contracted service allows, so they can check the status of their delivery.
5. Delivery incidents
The customer should check that the package is in good condition upon receipt. If the packaging shows visible damage, it is recommended to note it on the carrier’s delivery note and report it to PITBOX at pitbox.garaje@gmail.com within a maximum of 24-48 hours from receipt, providing photographs. In the event of loss, mislaying or damage during transport, PITBOX will handle the incident with the carrier and, where appropriate, replace the product or refund its amount. If a delivery fails due to causes attributable to the customer (incorrect address, repeated absence, non-collection at a pick-up point), the cost of a new shipment may be passed on to the customer. These recommendations do not affect the rights granted to the consumer by the legal guarantee.
B) Returns and right of withdrawal
1. Right of withdrawal (14 days)
In accordance with Article 102 TRLGDCU, the consumer has the right to withdraw from the contract within 14 calendar days without justification and without penalty. Under Article 104 TRLGDCU, in the case of goods the period runs from the day on which the customer (or a third party indicated by them, other than the carrier) acquires physical possession of the product. If PITBOX fails to provide the information on the right of withdrawal, the period is extended by 12 months in accordance with Article 105 TRLGDCU.
2. How to exercise withdrawal
To exercise the right of withdrawal, the customer must notify PITBOX of their decision by an unequivocal statement, for example by e-mail to pitbox.garaje@gmail.com, stating their name, order number and intention to withdraw. They may use the model withdrawal form at the end of this page, although its use is not mandatory. To meet the deadline, it is sufficient that the communication is sent before the 14 calendar-day period expires.
After notifying the withdrawal, the customer must return the product without undue delay and, in any case, within a maximum of 14 calendar days from the date they communicated their decision, to the address [RETURNS ADDRESS]. The direct costs of returning the product are borne by the customer, unless PITBOX states otherwise. The customer is liable for any diminished value of the product resulting from handling other than that necessary to establish its nature, characteristics and functioning (Art. 108.2 TRLGDCU).
3. Exception: bespoke / personalised button boxes
VERY IMPORTANT. In accordance with Article 103.c) TRLGDCU, there is NO right of withdrawal for the supply of goods made to the consumer’s specifications or clearly personalised.
Consequently, button boxes configured to order through the 3D configurator, or personalised in any way at the customer’s request (control layout, materials, colours, engravings, texts or other customisations), are EXCLUDED from the right of withdrawal. Once the order for a bespoke product is confirmed and paid, it cannot be returned or refunded by mere withdrawal. The customer expressly acknowledges and accepts this exclusion, via a checkbox, when placing the order for a personalised product.
Standard catalogue products that have not been made to order or clearly personalised DO retain the right of withdrawal under the terms of the previous sections. This exclusion does not affect the customer’s rights where the product is defective or not in conformity with the contract, which are governed by the legal guarantee described on the Warranty page.
4. Refunds
Where withdrawal (non-personalised products) or termination for lack of conformity applies, PITBOX will refund all payments received, including, where applicable, the standard delivery shipping costs (with the exception of additional costs arising from choosing a delivery method other than the cheapest one offered). The refund will be made without undue delay and, at the latest, within 14 calendar days from when PITBOX becomes aware of the withdrawal, using the same means of payment used by the customer, unless the customer expressly agrees otherwise and provided it entails no cost to them. In the case of withdrawal of goods, PITBOX may withhold the refund until it has received the returned product or until the customer provides proof of its return, whichever occurs first (Art. 107.3 TRLGDCU).
Annex — Model withdrawal form

Legal and Commercial Warranty
1. Legal guarantee of conformity (3 years)
All products sold by PITBOX are covered by the legal guarantee of conformity provided for in the TRLGDCU, as amended by Royal Decree-law 7/2021 of 27 April. The seller is liable to the consumer for any lack of conformity that exists at the time of delivery and becomes apparent within a period of three (3) years from delivery of the product (Art. 120 TRLGDCU).
Unless proven otherwise, any lack of conformity that becomes apparent within the first two (2) years from delivery is presumed to have existed at the time of delivery, with the burden of proof to the contrary falling on the seller (Art. 121 TRLGDCU).
The action to claim under the guarantee lapses five (5) years after the lack of conformity becomes apparent (Art. 124 TRLGDCU). The consumer is not required to report the lack of conformity within any set period: the former obligation to report it within two months was removed by Royal Decree-law 7/2021.
2. Liable party and remedies: repair, replacement, price reduction or termination
The party liable to the consumer is the seller (PITBOX), without prejudice to the consumer’s right to claim directly against the producer where appropriate (Art. 125 TRLGDCU). In the event of a lack of conformity, the consumer is entitled to have the product brought into conformity and may generally choose between repair or replacement, both free of charge for the consumer (including necessary costs such as shipping, labour or materials). If repair or replacement is impossible, disproportionate, not carried out within a reasonable time or without major inconvenience to the consumer, the consumer may demand a price reduction or termination of the contract (Arts. 118 and 119 TRLGDCU).
To claim under the guarantee, the customer must keep the invoice or proof of purchase and contact PITBOX at pitbox.garaje@gmail.com, describing the defect and attaching, if possible, photographs or videos. PITBOX will indicate the procedure for collection or return of the product.
3. Bespoke products
The legal guarantee of conformity applies equally to bespoke or personalised button boxes. Although these products are excluded from the right of withdrawal, personalisation does not release PITBOX from liability for manufacturing or material defects or for lack of conformity with what was agreed.
4. Warranty exclusions
The legal guarantee does not cover defects or damage caused by: improper or negligent use, handling or repair by unauthorised third parties, normal wear and tear from use, impacts, moisture, electrical surges or other causes unrelated to a manufacturing or material defect. Aesthetic variations inherent to the handcrafted nature of the product (small differences in finish or shade) are not considered a lack of conformity.
5. Additional commercial warranty from the workshop
[IF APPLICABLE] On an additional and voluntary basis, and without prejudice to the above legal guarantee, PITBOX offers a workshop commercial warranty of [DURATION/SCOPE, e.g. X months/years on certain components, wiring or electronics]. The specific conditions of this commercial warranty (duration, coverage, procedure and limitations) are detailed in [LOCATION / warranty document] and in no case reduce or replace the rights granted to the consumer by the legal guarantee.
